Terms of Service (or Rules and Regulations)

1. Introduction

The Rules and Regulations (or the Terms of Service) determine Terms of Service of the Moto-Notes internet applications, particularly the rights and obligations of registered users.

2. Definitions

  1. Rules and Regulations – a document which determines terms of using the System, rights and obligations of the User and the System Owner, terms of personal data protection and the others.
  2. Moto-Notes (or the System) – a system which provides internet tools (applications), such as the Notebook, available in moto-notes.com domain (together with another internet addresses passing on to the above mentioned domain, for example, moto-notes.pl) and in subdomains. ‘System’ and ‘Moto-Notes’ concepts are exchangeable and have the same meaning. The Moto-Notes structure is shown in the picture below.

  4. Notebook – an internet service available at the following address: notebook.moto-notes.com (together with another internet addresses passing on to the above mentioned address, for example notebook.moto-notes.pl) having the facilities described in the Rules and Regulations.
  5. Forum – an internet service available at the following address: board.moto-notes.com (together with another internet addresses passing on to the above mentioned address, for example board.moto-notes.pl) having the facilities described in Rules and Regulations.
  6. Guide – an internet service available at the following address: guide.moto-notes.com (together with another addresses passing on to the above mentioned address, for example guide.moto-notes.pl) having the facilities described in the Rules and Regulations.
  7. Owner (or Motonotes Team) is a group of people who are the creators of the Moto-Notes and the sub tools such as the Notebook to which the Motonotes Team has all rights reserved. ‘Owner’ and ‘Motonotes Team’ concepts are exchangeable and have the same meaning.
  8. Administrator – a person or persons appointed by the Motonotes Team. They maintain and manage the System, particularly they make sure whether the users obey the Terms of Services.
  9. User – a natural person who accepts the Terms of Services and registers in the system, thanks to which gets access to the services offered by the System Owner within the framework of Moto-Notes service.
  10. Parties – the User and the Owner.
  11. Registration – a procedure which must be followed by all users if they want to take advantage of the services offered by the System Owner within the framework of Moto-Notes service.
  12. Account (or User Profile) – an existing in the system database registration which confirms that the owner of the Account is the User of the System, accepts the Terms of Service and is bound by the Rules and Regulations.

3. General regulations

  1. System functionality
    1. Moto-Notes – the System main page which contains the ultimate information of the System, news, statistics, etc. It enables to navigate between sub tools which are the integral part of the Moto-Notes.
    2. Notebook – the Internet Automotive Notebook is a tool which is a part of the Moto-Notes. Its main role is to help the User to manage all the activities and expenses regarding a vehicle or vehicles exploitation. In the Notebook there are, among others, reminders, notes, analyses and many more tools which help to keep the vehicle under control.
    3. Guide – the Internet Automotive Guide is a tool which is a part of the Moto-Notes. The Guide enables the User to draw a route on a road map, then release or send it to friends or just use for the user’s own purpose.
    4. Forum – the Internet Automotive Forum is a tool which is a part of the Moto-Notes. Its main purpose is to associate those people who are interested in automotive and the like topics. The Forum enables the users to discuss over interesting automotive issues, share their experiences, find solutions to problems connected with a vehicle exploitation and many others.
  2. Terms of using the System
    1. A natural person, a legal person or an organization with legal entity and an e-mail account can be the User of the System. A natural person can be the User if they have the appropriate law capacity or if the law capacity is limited, they have a special permission provided by a legal authority.
    2. By registering the Account, the User agrees to all the terms of the Rules and Regulations and accepts to obey them. In case the user stops accepting any of the terms of service, they are obliged to remove their account immediately or to let the Administrator know about the lack of agreement.
    3. The agreement for providing the electronic services is concluded the moment when the User starts taking advantage of the services provided by the Owner within the framework of the Moto-Notes. Sending a filled registration form means that the User starts using the services. The services are provided only to registered users after logging in the System.
    4. The agreement is concluded for an unlimited time period.
    5. Access to most of the services is free of charge, in particular you do not have to pay for the registration and completing the user profile.
    6. The Owner of the System reserves the right to start charging fees for any services provided by the Moto-Notes.
    7. The Owner of the System reserves the right to make any changes in the services, tools and the way the System works. The Owner also reserves the right to remove any data from the database, stop running the business, transfer the rights to the Moto-Notes and take any lawful actions connected with the System. The User cannot set up any claims to the System Owner with regards to the actions mentioned above.
    8. The User gives the System Owner the right to display to the user any commercial offers and announcements which can be also sent to the user mailbox.
    9. Moto-Notes is open to the public. All the data given by the User is open and can be made public in the User Profile. In particular, it can be available to another Internet users and can be indexed by browsers.
    10. All activities which can make it difficult for the System to work or destabilize it are unacceptable. In case of acting against the rules of service, the user’s account can be blocked. In that case, the User can be brought to account for any damage caused to the System Owner. Any attempts to destabilize the service can be regarded as a crime.

5. Registration, Account and deregistration

  1. In order to take advantage of the System facilities you need to register by filling in the registration form.
  2. The User is obliged to give true data and remember to update the data in case of any changes.
  3. If the data is untrue or it is a possibility of it to be inauthentic or out-of-date, the Administrator can:
    1. ask for documents which confirm if the data is true
    2. order the User to correct the data
    3. block the User account until any doubts are cleared up
    4. remove the User account in course of action described in the Rules and Regulations
  4. Registering means giving permission to process personal data given while registering and all the other user data in the System. More details about processing data can be found in the Rules and Regulation attachment, Private Policy.
  5. The registration is complete and results in opening the User Account when the User:
    1. confirms accepting the Rules and Regulations
    2. agrees to process data in accordance with the terms described in the Rules and Regulations
    3. agrees to display the data in the Profile
    4. confirms authenticity of the data in the registration form
    5. gives permission for receiving any System announcements and commercial information to the email address given in the registration form.

    Deregistration is:

    1. If the User is intended to deregister. In that case, the User sends a suitable email to the address displayed on the website of the System or, if such a facility is available, deregister from the System alone
    2. When it is a decision made by the Administrator of the System (such a decision may result from the incorrectness described above or any other reasons without the Administrator explanation)
  6. Deregistration is made by deleting the User Account by the Administrator. All the data regarding the User, except the one which is statistic data, is removed from the System.
  7. 6. Parties rights and responsibilities. Copyright laws.

    1. The User is fully responsible for the data given and confirms its authenticity, reliability, completeness and relevance.
    2. The Owner of the System is not responsible for any consequences resulting from taking advantage of the information about the registered users.
    3. The User accepts and confirms that the copyright laws, trademarks, the users accounts and the intellectual property connected with the System belong to the Owner of the System.
    4. All rights reserved. Using the rights for other purposes than the ones allowed by the System and described in the Rules and Regulations is prohibited.
    5. All registered users are allowed to see and update their data.
    6. By making public all the data, image and other materials, the User agrees to use them by other users for their own personal purpose.
    7. The Owner of the System is not responsible for any physical and law defects of free products offered and the quality of free products and services. No responsibility is taken for the effects of any commitments made and obligations met through the agency of the System.
    8. The Owner of the System cannot guarantee the System or its parts will work properly and takes no responsibility for any damage caused by errors, system crash and breaks in the System functionality.
    9. The Owner of the System is not responsible for any users data, particularly for any users statements and comments posted in the System

    All the details of Help can be found in an extra Help link displayed on the home page of the System.

    8. Final regulations

    1. Any disputes regarding the System functionality and use will be settled legally in Polish court, on the basis of the Rules and Regulations.
    2. The Owner of the System reserves the right to make changes in the Rules of Regulations without giving the reason.
    3. In case of any changes made in the Rules and Regulations, the appropriate information will be displayed soon after the User logs in the System. The User is obliged to accept the changes and confirm that by following the instructions provided. In case of refusing to accept the changes in the Rules and Regulations, the User is obliged to stop using the System and deregister.
    4. If one of the regulations of the Terms of Service is regarded as invalid or impossible to realize by the law, the other regulations are still valid and legally binding.
    5. The User to whom the registration procedure described in p. 5 f. ii. was applied, is not allowed to register again without agreement from the System Owner.
